Ownership, Privacy and Security

Simonsoft alone (and its licensors, where applicable) shall own all right, title and interest, including all related Intellectual Property Rights, in and to the Simonsoft Technology and the Service and any suggestions, documentation, know-how, ideas, enhancement requests, feedback, recommendations or any other information provided to the Client or any other party relating to the Service.

This Agreement does not entail a transfer of any rights of ownership in or related to the Service, the Simonsoft Technology or the Intellectual Property Rights owned by Simonsoft. The Simonsoft name, the Simonsoft logo, and the product names associated with the Software or Services are trademarks of Simonsoft or third parties, and no right or license is granted to use them. Simonsoft cannot be held liable for any breach of other intellectual property rights, due to the use of the Software and/or other Services provided by Simonsoft. The Client recognizes and guarantees that Simonsoft does not breach intellectual property rights or other rights of the Client or any third party.

The Client is, and will always remain, the owner of their personal data. The Client will also remain the owner of all data created using the Simonsoft Services.

Support staff from Simonsoft and, when applicable, the Reselling Partner and/or Consulting Partner have access to the Instance and the data for the purpose of providing support and maintenance services.

Simonsoft may track and analyse the usage of the Services for purposes of determining usage made of the Services, for the purposes of security, to assist customers, and for improving the Services and services and the user experience in using such Services and services. For example, Simonsoft may use this information to help customers derive more value from the Services and services, to understand and analyse trends, or to track which features are used most often in order to improve the Services and services. Simonsoft may share anonymous usage data with its service providers for the purpose of helping in such tracking, analysis and improvements. Additionally, Simonsoft may share such anonymous usage data on an aggregate basis in the normal course of operating their business; for example, Simonsoft may share information publicly to show trends about the general use of its software and services.
